In the event of a conflict between these Terms of Use and those terms and conditions, those terms and conditions will take precedence in relation to your use of the Website and its Services to search for and/ or to advertise to those seeking alternative finance.

2. Access to the Site and Services

2.1. The Website can be used by those seeking to compare banks in the UK and/ or to read reviews, articles and information on banks and related topics for their own personal use.

2.3. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.

4. Material Submitted by You

4.1. Although we do not intend to, and shall take all legally required steps to ensure that we do not, make the content of user areas available to third parties or publicly viewable except as specifically agreed (e.g. if you ask to be included in our database of banks that can be searched by those who use our Website), such information shall not be considered confidential. Further, if and to the extent that we enable you to upload material to our site, in your user area, in an advert for your banking offering or otherwise, any such material you provide to us for our site will be considered non-confidential and non-proprietary and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose relating to the provision of our Services. We also have the right to disclose your identity to any third party who is claiming that any material provided by you for our site constitutes a violation of their intellectual property rights or of their right to privacy.

4.3. We are not obliged to use material submitted by you and we may remove from the Website, the Services and our database any of the material submitted by you at our sole discretion.

4.4. We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone submitting material in breach of clause 4.2.

For the avoidance of doubt, a “match” for you that is generated by your use of the Website does not constitute an offer or acceptance of an alternative finance arrangement.

6.3. If you use the Website to seek bank information, you acknowledge that we are not responsible for the content of any advert for banks or banking and that accordingly, it is a matter for you to satisfy yourself as to the suitability of the alternative finance offered and the identity of the lender.

7. Our Liability

7.1. The material contained on the Site and in the Services is for information purposes only and does not constitute advice. You should carry out your own check in respect of any information on the Site and in the Services and use your own judgement before doing or not doing anything on the basis of what you see. Unless expressly stated otherwise in writing by us or required by law, we exclude all conditions, warranties, representations or other terms which may apply to the Site or to any content on it and in the Services, as further described in the Warranty section below.

9. Applicable Law and Jurisdiction

These Terms of Use are governed by English law. The English courts shall have exclusive jurisdiction over any claim brought by you arising from, or related to, your use of the Website and Services and these Terms of Use. However, if you are a consumer user, you and we agree the courts of England and Wales will have non-exclusive jurisdiction over any such disputes between us and if you are a consumer user and you are a resident of Northern Ireland/ Scotland you may also bring proceedings in Northern Ireland/ Scotland accordingly.
